The most important thing you can do to stay out of jail is “Don’t Talk to the Police!”
Most of the cases we fight in court are made harder by one simple thing. People talk to the police. They shouldn’t.
Understand that we don’t want to vilify police officers, investigators or detectives. We just know that their job is to arrest and get convictions. they’re just doing their job.
The problem is that their job is not to protect the rights of innocent individuals. Innocent individuals need to protect themselves. Don’t give a statement to a police officer. Don’t engage in casual conversations like “Where you goin?” or “Where did you come from?” These are called bait. Even a simple speeding ticket can lead to a cop arresting you for something you haven’t done.
This does not give you license to be a jerk. Remember that police are people, too. If you are rude, you immediately set the tone of the interaction, and once it’s started as an antagonistic back and forth it will likely degrade.
If you are driving and stopped by police, provide the officer with your license, registration and (in South Carolina) proof of insurance. Then let him tell you why you were pulled over. If needed then sign his ticket and be on your way.
