The best case scenario (which is a long shot) is that the police officer will administer your test and then say, “Congratulations! You’re absolutely Sober – have a nice day!”
If you have ever seen one YouTube video showing that – please share it! We’ve never seen it. Let’s be clear The is no situation where a roadside test will help you. If you don’t have any alcohol in your system an officer can say that your eyes didn’t follow his pen or that your pupils were not responsive or any number of things.
Another bad thing to come of it is that your dash-cam video can make you famous – for the wrong reasons.
If you DO submit to roadside tests there are any number of things that can go wrong for you. If you DO NOT take the test you might lose your license for not taking the test, but you have not given the police and prosecutors EVIDENCE for your conviction of anything else. Losing your license for 6 months – without points and without a knock on your insurance – can also be mitigated by getting a provisional license for work.
Even if you are not intoxicated in any way, you can still be prosecuted for DUI
Understand that many cops think it is there DUTY to get convictions. This is why you should not take tests and do not answer questions (if you are nervous and give an answer they think is off, they might still arrest you) ever.
